The Transport Basic Bill was approved in the cabinet meeting on March 8, 2011. Government should have submitted the bill to the 177th Congress if the East Japan Earthquake didn't occur. Will the Transport Basic Act be successful in assuring human right to transport? Will it be useful to resolute many transport problems especially in transport poor area and transport poor people? This article approaches that question through studying the bill and some reports published by Ministry of Land, Infrastructure, Transport and Tourism.

本稿では、以下の検討を通じて、ガバナンス概念の有用性を明らかにし、具体的な事例への汎用性を導くことを目的とする。第一にコミュニティの担い手組織の区分と対立・連携をめぐる議論を整理する。第二にガバナンス概念から過程と対抗の要素を抽出し、多元的な主体の役割分担によるガバナンスの多様化と、権限の委譲によるガバナンスの多層化について検討する。第三にサブ・ローカルな水準のガバナンス概念を具体的に検討するために、担い手の対立から結社創出にいたるまちづくりの事例研究を行う。担い手組織としてのボランタリー・アソシエーション (VA) は、公認/非公認、表出的=共楽型/手段的=共苦型など様々な軸の組み合わせで区分される。闘争の結社創出と団結の過程に注目すれば、それらを通じて何を継承していくのかについて考える必要があり、また、闘争の社会的遍在性に依拠すれば、それは社会の形成・存続・発展にとって意義がある。つまり、担い手の対立過程を容認することで、ガバナンスの有用性や汎用性も高まると考えられる。
