In May 2008, the Amended International Convention for the Safety of Life at Sea (SOLAS) was adopted. The main purpose of this amendment was to separate investigations to identify causes in marine accidents from any proceedings to apportion blame or liability. In addition, the Japan Transport Safety Board and Japan Marine Accident Tribunal were established in October, 2008. The Japan Marine Accident Tribunal takes disciplinary actions without investigating the causes of marine accidents.
This paper examined the Marine Accident Investigation Report and the Written Judgement of the Marine Accident Tribunal, and pointed out differences in analysis of Sailing Rules.
