The Land Acquisition (Amendment) Act of 1991 in Malaysia to promote economic development has institutionally enabled arbitrary land acquisition. Section 68A newly established in the 1991 Amendment Act has stipulated that whether before or after the commencement of this section, no subsequent disposal or use of, or dealing with, the land shall invalidate the acquisition of the land. This study considers when introducing the land acquisition system for profit-oriented enterprises, what legal provision need to be set to deal with what kinds of situation.
