Abstract
In recent years, it is reported the violations of “the ordinary practice of seamen”are increasing in marine accident inquiries. It can be inferred from a stretched interpretation of “the ordinary practice of seamen”.
After all, it means that there is no clear concept of “the ordinary practice of seamen” in Japan. Therefore, this paper is an attempt to overview a new interpretation of “the ordinary practice of seamen” in Japan.
Formerly“best aid to avert collision”was synonymous with “the ordinary practice of seamen”. So, it is considered that there is a relation between “action by stand-on vessel”and“the ordinary practice of seamen”. Finally, the issue of marine accident inquiry system is studied on the base a stretched interpretation of “the ordinary practice of seamen”.
