Patent information research for the negotiation of licensing

Abstract

Patent search is very important for both the selection of the technology to be licensed and the negotiation of a license agreement. Both Licensor and licensee shall conduct the sufficient patent search beforehand. In case of plant license it is common that the licensed technology consists of various technologies or elements. So the items for the patent search will be very large. The daily work to check and review of third party’s patents will be necessary for the licensor to secure its own technology and the party that wants to be granted a license shall select such party that is reliable and/or has rich experiences of licensing.
