Abstract

In the case of river improvement in Tokyo, the Tokyo Metropolitan Government promotes projects by applying the River Law and the Urban Planning Act.

The purpose of this paper is to clarify the conditions for its application.

The main advantages of implementing projects based on the Urban Planning Act instead of the River Law for river rehabilitation in the capital city are the following two points.

1) Urban planning lines based on river improvement plans can be publicly notified in accordance with Articles 20 of the Act, and restrictions on buildings can be enforced in accordance with Article 53 of the Act.

2) The project is regarded as a project under the Eminent Domain Law and is authorized as a project with the Urban Planning Act without separate procedures.
