ABSTRACT : The objective of this paper is to clarify the actual conditions and problems of fishery restriction compensation for the Okinawa waters by illustrating the institutional framework and the characteristics of compensation calculation method based on the so-called "Fishing Operation Restriction Law" . Features of restriction compensation include: it is calculated based on the fishery income amount at the time of restriction; a mechanism is flexibly adapted to changes in the fishery in response to the environmental changes surrounding the fishery; fair and impartial procedures are prepared for the operation; it is contributing to the fisherman's household and the local economies. The scheme, however, has several points to be improved: there was room for causing "moral hazard" in operation; the influence of factors including the fishing characteristics, ground abundance, and the operation period on fishery production efficiency is not taken into consideration at the time of calculating the compensation amount; the calculation is based on the market price of fish which is strongly affected by market fluctuations; the operation of the scheme after retirement of legitimate compensation recipients is undetermined. Redesigning of the system that takes such issues including market fluctuation risk and "vulnerability of fishery" into account is required.
