On the Significance of the Supreme Court Decision (May 17, 2021) recognizing the Government’s Responsibility for Damage to Construction Workers Due to Asbestos and Legal Policies for Ensuring the Health and Safety of the Self-Employed

Abstract

This paper clarifies the content and significance of the Supreme Court decision (May 17, 2021) that recognized the government’s liability for damages caused by Asbestos to construction workers. In response to this Supreme Court decision, the Ministry of Health, Labor and Welfare revised the Industrial Safety and Health Regulations on April 15, 2022. By introducing the revised content, I will consider how health and safety for the self-employed should be implemented.
