Abstract
In this mock trial session, the case in question involves handling aggressive personalities, habitual drinking, physical illness, and requests for returning to remote work. Additionally, it deals with the disappearance of superficial reasons for leave of absence and the suspected presence of underlying mental health symptoms as the true root cause.
In this case, discussions were held from multiple perspectives. Firstly, the appropriateness of the responses from both the worker and the company was examined. Then, the issue of the worker’s non-cooperation with the medical examination by the company-appointed doctor was addressed. Additionally, there was a debate on the disappearance and addition of reasons for the leave of absence. These points were discussed from the viewpoints of the worker’s lawyer, the primary care physician, the company’s lawyer, the occupational physician, and a summarizing commentator (also an occupational physician).
Through the discussions, it became evident that differences in perspectives and approaches to the case exist due to the distinct positions of law and medicine and those of employers and employees. Moreover, the importance of expert communication in clarifying the essence of the case was highlighted, especially from the viewpoint of achieving ‘better occupational health responses.’
