Abstract
This paper shows the relationship between "uncertainty" and "innovation" in ELSI management surrounding AI technology, which is an advanced science and technology. In other words, this study examines the possibility that precautionary measures against this uncertainty can lead to the promotion of innovation. Specifically, this paper points out the difference between "risk management" and "uncertainty management" of AI technology and the necessity for them. Then, focusing on the E (ethics) and L (law) of ELSI, a new perspective is presented on the two aspects of "dual ethics" and "dual law" and the relationship between the two. Based on this, this paper shows the possibility that "legal innovation" can be created not only in dealing with "scientific uncertainty" surrounding AI technology, but also in the process of dealing with "ethical uncertainty."
