How will evolving software development and contracts change?

Abstract

Based on the conventional contract for waterfall type software development and the impact of the revised Civil Code of 2017 (enforced from April 1, 2010, except for some provisions) on it, this paper reports on the ideal way of contracts for agile software development, which is one of the typical non-waterfall type software development. To be sustainable under the “new normal” with novel coronavirus and to be resistant to environmental changes, companies are required “continue to innovate” and DX (Digital Transformation) is a management issue as a source of competitiveness. Under such circumstances, not only software development way but also the way of contracts is required to change.
