In corporate activities, intellectual property is important in the creation of new businesses. In the innovation strategy of a company, it is not necessary to stick to the exclusive use of intellectual property, and in some cases, intellectual property may be licensed in accordance with the concept of open innovation. An IP trust may be a useful option to realize the rights and utilization of IP as a management resource. An IP trust refers to a system in which the management and utilization of intellectual property is entrusted to an IP specialist for a certain purpose. In this study, I focus on IP trusts as a method to promote open innovation, and investigate the following By analyzing patent management (patent application, request for examination, divisional application, appeal against examiner’s decision of refusal, etc.) for holding patent rights, this study discusses a method of patent rights acquisition based on a patent utilization strategy by a utilization-type IP trust.
