Abstract

 In this study, the followings are organized. Idea of right of innocent passage in international transportation, discussions on the right to move to the Basic Act on Transportation Policy in Japan, concept and concrete method of land expropriation, and the scheme and solution of right-of-way in private land. As a result of the coordination, it was found that the common concept is to emphasize the interests of the passing side, and that the passing is innocent passage in principle, and that the passing side is basically responsible for any costs incurred.

 Those were considered that Shinkansen project has a public interest and that from the perspective of local service levels between conflicting areas, there is no rational reason that at least the area with the Shinkansen can thwart the future projects in unfinished areas. Based on these analysis, the direction of a certain solution was shown in conclusion.
