Discussion on the employee's invention system and the honoring system

Abstract

On April 1st, 2016, revised Patent Law was enforced, and provisions related to the employee's invention were revised. Under the former system, the patent rights (the rights to obtain patents) of inventions invented in companies belonged to inventors, and then transferred to corporations. Under the present system, the patent rights (the rights to obtain patents) can belong to corporations from the beginning. Moreover, under the present system, inventors can obtain “reasonable profit” which corresponds to “reasonable value” in the former system. In the revised Patent Law, “reasonable profit” means “money and the other profit”. According to a research reported by the Japan Patent Office, “money” is very important for inventors as a insentive for their researches. However, according to another research reported by the Patent Office, the honoring system includes “A testimonial”, “a medal”, “a shield”, “a trophy”, “a product”, “stock option”, “the dining together with officers” and etc other than “money”. Also, a commendation ceremony is often held, and the inventors by the prize winner provide their lectures there. In this paper, “profits other than money” are discussed.
