Excess Condemnation, which had been provided in the Town Planning Act of 1919, had been abolished in 1955, but it was readopted into the Act for Redevelopment related to to Public Works of 1961. This article inquires that process of adoptation of excess condemnation to the Act of 1961 and comes to the conclusion as follows : 1) The Act of 1961 clarified the application area of excess condemnation to the build-up ones. 2) And it aimed to relief residents so they could remain in the same area. 3) And the works of excess condemnation was limitted to the redevelopment projects.
