Abstract
This paper aims to investigate the system of coordination between interests in plan decision procedure of public projects in Germany, and to consider the problems of the procedure in Japan. At first, this study examined the process, role, public notice, and the location of plan decision procedure in Germany. The procedure is connected with many other legal procedures, so this paper tried to make clear the links between the procedure and other legal systems. Interests of projects are coordinated through hearings at plan decision procedure, and the hearings are held after all stakeholders have read open documents which show each numerical value of impact, for example, noise, purity of drain, etc. This paper gave an example of one part of A94 national speedway at Bayern. At the last planning approval, Japan had no such hearing procedure like Germany, however such a procedure is very important when considering openness and fairness.
