1306 The protection and use for Databases : especially from the points of copyright, unfair competitons, "Sui Generis Right", and the technical aspects

The databases have been mainly protected by Copyright Law and Tort Law in Japan, but each protection has many differences, and it seems to be little functional that "the sweat of the brow" isn't protected very much. So, I think new protection will be demanded, and I shall study the possibilities for the databases to be protected by Unfair Competition Law, and "Sui Geneis Right" (the database right) on the legal aspects as well as the technical ones. Meanwhile, I shall also study the use of the databases in more detail, considering the balance among the authors of the databases, the users of them, the data holders, and "the data miners" from now on.
