Abstract

On September 30 2003, Kochi District Court judged that the judgment Kochi city had made that building a cinema complex in AEON Kochi Shopping Center couldn't have been permitted was against the law. In consequence, it opened on July 17 2004 with the exceptional permission of Clause 11, Article 48 of the Building Standard Law.This paper arranges the data on this case, studies them from the viewpoint of "tolerance" and "necessity", and presents problems of the restriction of master plans, the common good of revitalization of city centers, and the criterion of consensus of citizen.
