Abstract
Regarding a person deemed to have sufficient knowledge and skill in Article 40 Paragraph 3 of the Ordinance on Industrial Safety and Health, it is said that education concerning the said matters can be omitted, but does the person actually have sufficient knowledge and skill? In particular, a review was carried out based on actual cases of foremen, and operations chiefs for tasks such as scaffolding assembly, relating to the falling accidents which are one of the three major accidents. In the results, the types of foreman work exhibiting an increasing trend were: a) Self-inspection, b) Actual work, and c) Work instruction and supervision. Regarding the foreman appointment ratio and rate of receiving education for improving capabilities, based on Article 40 Paragraph 3 of the Ordinance on Industrial Safety and Health, it was found that foremen who exceeded 10% every year and were selected based on Paragraph 3 did not have enough between knowledge and techniques relating to RA. In addition, the rate of receiving education to improve capabilities was equivalent to zero in the case for foremen, and in the case of operations chiefs for tasks such as scaffold assembly, it was on a level which made it possible to discover persons who had received education from the previous fiscal year, and thus it will likely be necessary to promote measures to encourage undergoing education to improve capabilities. Therefore, to take measures to further reduce risks, there will likely be a need to amend Article 14 and Article 60 of the Industrial Safety and Health Act, and Article 40 Paragraph 3 of the Ordinance on Industrial Safety and Health, and thereby amend to rules on skills training for operations chiefs for tasks such as scaffolding assembly, to suit the actual conditions of work.
