Legal Issues around Generative AI and Digital Archives: Focusing on Copyright

Abstract

Archive institutions may face legal challenges, especially copyright infringement, when training a generative AI model, as well as when producing new content with it. This paper explains the key issues surrounding generative AI and copyright law through case studies of archival institutions.
