材料分野の代表として「鋼」に関する具体的な特許出願審査の事例を取り上げ、その実情と問題点について紹介する。本事例は特許庁審査部の審査により、一旦特許となったが、その権利範囲が既存の鋼製品にまで及ぶ可能性を有した事例。出願内容の新規性を直接的に否定する文献はないが、基礎的な「金属学」「材料力学」に立脚すれば、審査段階で進歩性を否定できたと考えられる。異議申立により無効とされたが、最終的に東京高裁まで争われた。

Recently, the terminology of "lift-off flame" is proposed in the case of diesel combustion. However, this terminology is precisely defined in the burning of pre-mixed gas, thus, it is not always suitable to use in the field of diesel combustion. The reason is why the part of a diesel spray near the nozzle exit is too dense to break out the flame because the number density of droplets is too much dense and their velocity is too first to prepare the mixture for the ignition. The author proposes the new terminology of "no flame region" instead of lift-off flame based on his previous investigation on the characteristics of diesel spray and those of its combustion.
