    The victim who caught psychosomatic damage by participating in self improvement seminar which was educational cult exists abundantly. This psychosomatic damage is the wound caught by mind rape. It can't complain about it, and it is everywhere as for the victims the damage of mind rape. It is rare that the problem of self improvement seminar is brought even into the judgment specially. Two factors exist greatly as a reason. To begin with, cult group are to control a member by using mind control. Secoundly, self improvement seminar are to use that it is hard to judge by law for mind control. This report analyzes about mind control and mind rape by cult group. Then, a past precedent is taken up about the damage of self improvement seminar. It is examined how it was interpreted about mind rape in the judgment from the precedent. The need of the social support system to the victim of mind rape is suggested at the end.

    The 93^<rd> general meeting and symposium of our Law and Politics Society were held at Keio University (Mita Campus) on November 18th and 19th of the year 2000. The main theme was "IT revolution and its Legal and Political Ramifications" the symposium was preceded by two commemorative lectures given by Professor Heizo Takenaka of Keio University and Mr.Shun Sakurai of the Communication Bureau in the Ministry of Posts and Telecommunications. Both were leading members of the IT strategy meeting. Professor Takenaka, an influential economist in our country, spoke on the theme of "The Japanese Economy Under the IT Revolution and Policy Management." Mr. Sakurai who is directly taking charge of promoting the IT Revolution in Japan gave a lecture with the theme "Promoting the IT Revolution." Both lectures were very instructive and useful. We appreciate not only the two speakers but also the planning committee, which chose such a suitable theme with the 21-century so near at hand. Following the lectures five panelists presented their research in this session. First, Mr. Toyohiko Ohasi of NEC Research Institute and Shomi Gakuen University presented on the theme of "The Electronic Government's Present Condition and the Way the Government Should be and Whether IT could be the Cause to Change Administration." It was an informative report, which was a persuasive using experience rich from business field. Second, Mr. Hiroyuki Nagayama of Hiroshima University presented on the theme of "IT, the Government, and Governance." He discussed the theme of illegal access prohibitive law with respect to the problem of network security. Third, Mr. Masakiyo Kimura of Assistant and Best Consultant Office presented on the theme of "IT Strategy and Strategic Management." He said that the problem was how management is connected to IT strategy. Fourth, Mr. Yasuhiko Ooishi of Kansai University presented on the theme of "IT Revolution and Protection of Personal Information." He discussed the constitutional position of protection of personal information and a detailed analysis based on facts made from this organic act. The last panelist Mr. Kotaku Ishido of Chukyo University presented on the theme of "IT Revolution and Computer Related Crime." He indicated that high-tech crime is increasing and the current sentences were not acting as an effective deterrent. There were some questions and answers after these important presentations. This symposium ended successfully at 17:15. We are thankful for all of the people at Keio University who helped organize this meeting.

    The main argument of this paper is that the permeation of the information technology to the society changes the role of the government. We analyze the 2000 regulation on the non-authorized access to computer networks as the case. The survey on the formation, the content, and the effectiveness of that regulation make clear the retreat of the law-enforcement agency from the center of the public security. In turn, each computer network and each user have to protect their security for oneself. Consequently, the role of the government on the public security becomes "support" from "law-enforcement." The relationship between government and society becomes "cooperative" rather than "controlling." The conclusion is that in the networking society it puts much importance to the governance system.

    Im Augenblick ist "IT Strategie" in die Mode gekommen. : Unternehmen haben die Tendenz, die Einfuhrung der Informationstechnologie wie Internet, in die unternehmenspolitische Zielsetzung mit einzubeziehen und sich damit aktiv zu beschaftigen. Es ist nicht ubertrieben, wenn ich sage, dass es Unternehmen gar nicht geling, die Konkurrenz zu uberleben, ohne die Informationstechnologie effizient auszunutzen. Aber mir kommen doch Bedenken, ob alle Unternehmen "IT" als strategischse Waffe wirklichh ausnutzen. Unter dem Gesichtspunkt des strategischen Manegementsystems wirft der Bericht einige Fragen ein.

    It is the subject that a doctor's obligation to disclose is important with the modern medical treatment. The legal composition of the obligation to disclose, the range of an explanation should be made concretely becomes a problem. It is examined that the good faith gives a doctor's obligation to disclose what kind of influence, by this thesis. It is discussed that if there is a obligation to disclose, to inquire into the cause of a patient's death on hospital side faces the patient's bereaved.

    Le divorce pour rupture de lavie commune a ete l'innovation la plus discutee la loi de 1975. Le rupture de la vie commune qui justifie le divorce doit etre caracterisee soit par une separation de fait, soit par une alteration des facultes. L'une et l' autre doivent avoir dure au moins six ans. Dans une l' autre cas, le dumandeur doit assumer toutes les charges du marriage, bien qu' il soit rompu. Si le defendeur <<etablit que le divorce aurait, soit pour lui, soit pour les enfants, des consequences materielles d'une exeptionnelle durete, le juge rejette la demande>>(a.240). La defendeur doit invoquer ce moyen de defese pour qu' il puisse etre accueilli, sauf dans le divorce pour cause d' alteration des facultes mentales, ou le juge peut le relever d' office. Le juge n' pas a apprecier les causes de la rupture, mais seulement la cruaute de ses consequences. Il faut, d'abord, souligner que ce sont, en pratique, toujours les femmes defenderesses qui l'invoquent. Le juge retiennent essentiellement l'age et la duree du marriage, mais se fondent egalument sur la situation patrimoniale, sur l'etat de sante, sur les convictions religieuses ou personnelles de la femme, qui lui feraient ressentir durement un divoece qui risquerait, dans certains milieux encore, d'etre regaedee, de maniere pejorative.

    Since the establishment of Hosokawa cabinet in 1993, Politics in Japan has entered into the era of coalition government. With the coming of this era, policy-making process of Japanese government has also largely changed. The center of policy-making process shifted from the hand of government to the ruling parties. Aa a result, ruling parties have to spend much energy for policy adjustment between them and, thus, have difficulty in holding opportunities of negotiation with opposition parties for correction and adjustment of policy.     This essay is to review the studies on graphic media in poltical sciences in terms of the construction of reality, and to apply these findings to the case in Japanese politics. Very few studies are on the role of graphic media in political sciences because of the myth that media in themselves do not have any effect on political and policy process. Political communication research has found that mass media "constructs social reality." In graphic media research four types are included: "distortion" , "symbolism" , "semiotics" , "ep-istemology" . There are differences between photographs and political cartoons. The content analysis on the visual media case make clear the differences:photos take the role in direct respose to stories in newspapers, while political cartoons are metaphorical or peripheral to them.

    While the number of international civil actions have been increasing, we have to recognize that there is no internationally harmonized rules for determining jurisdiction. In Japan, on October 16, 1981, the Supreme Court, in the Malaysian Airline Case, showed a standard for international jurisdiction in consideration of "special circumstances," the standard which the lower courts have in principle abided by. Following these cases, the Supreme Court reaffirmed the standard in a certain property case decided on November 11, 1997. At present, the continuing Hague Conference on Private International Law is at the last stage, where the establishment of an internationally harmonized rule "the Convention on Jurisdiction and Foreign Judgements in Civil and Commercial Matters" (the "Convention") is expected for international jurisdiction. Conclusion thereof will result in legislative resolution of the issues. Because I understand the consideration regarding "special circumstances could have significance for the interpretation and application of the Convention by the courts, I will examine the applicability and competence of the "special circumstances" standard for determining jurisdiction under the Convention.
