    This treatise comments the limit of the revision of the constitution of a state. First of all, we must distinguish the difference between the establishment of the constitution and its revision or amendment. The constitution-making power is an absolutely unlimited power and can establish any constitution that the state wants. But different from the constitution-making power, the constitution-revising competence is necessarily restricted by the principles and inherent spirit of the positive constitution of the state. Why the reason? Because we must, first of all, know the different charactor between the constitution-making power and constitution-revis-ing competence. That is, as a famous French constitutionalist, Si-eyes, 18ct., said, constitution-making power is an unconditional, unlimited, creative power (pouvoir constituant) and cannot be limited or conditioned by any other powers. But being distinguished from this, constitution-revising competence is merely a right in the region establishied by the constitution. So, to make the point clear, I will explain the purport as follows.- (1)Constitution-making power (pouvoir constituant) is creative, original and inherent power and cannot be limited by any other powers and so it is unlimited. (2)Constitution-revising competence (pouvoir constitue) is only a right of positive law and it is only a competence and cannot be

    This paper an extract from my presentation "Family Succession in the Meiji Civil Code" given at the Japan Association of Legal and Political Sciences in May of 1982. My research and this introduced theme is based on the case of Count Nogi. When Emperor Meiji passed away in 1912, General Maresuke Nogi committed suicide with his wife. He had also decided to end the Nogi family line, and towards this he refused any adoption into that family. His will stated that the Nogi line would be ended not to be revived. Following his instruction, the Nogi line was rooted out. But, on the third anniversary of his death in 1915, the Nogi line was restored by Motosato Mori, the second son of Maresuke Nogi's former feudal lord, Mototoshi Mori, not by one of Gen. Nogi's relatives. Motosato Mori was conferred the title of count by Emperor Taisho. In addition, Mori changed his family neme to Nogi and took possession of the Nogi graveyard, lineage and other ancestral treasures. This incident brought about serious disputes concerning the social, legal, political, moral and other aspects ; the incident meant that Nogi's will was ignored and there were lost of legal problems left unsolved.     Im modernen burgerlichen Recht der Besitz und die ungerechtfertigte Bereicherung eine gleiche Rolle spielt. Sie namlich sind eine Regel, die regelt das gerechte und ungerechte Verhaltnis. Das vergleicht mit dem richtigten und unrichtigten Verhaltnis, und im Recht die Gerechtigkeit das Eigentumrecht und der Vertrag ist, so im Recht der Besitz und die ungerechtefertige Bereicherung entgegen dem Eigentum und dem Vertrag setzt. Also, ist der Besitz bestimmt, dass der regelt den gerechten und ungerechten Verhalt in Sachenrecht, so die ungerechtige Bereicherung regelt den Verhalt im Obligatio. Der Besitz ist namlich die dingliche Ordnung die keine Eigentumordnung ferffend ist, und die ungerechtfertige Bereicherung ist die obligatiorische ist, und die ungerechtfertige Bereicherung ist die obligatiorische Ordung keine Vertragordnung. Also, bei modernen Pandektischensystem soll erst man beide jeder in das Sachenrecht oder Obligationrecht teilen. So man kann erst den Besitz vom Gegenstand der ungerechtfertigen Bereicherung ausschliessen. Das ferner ist in der Liquidation des Vertrag, namlich dem Anspruch auf die Wiederabtretung der fehlerhaften durchgefuhrten Leistung, und so weiter geteilt. Diese ist die Eingriffscondictio, jene ist die Leistungscondictio. Also, mag mandie Eingriffsondictio ist einer Unbesitz und eine Unleistungscondictio, bestimmt.

    Ancient days, Okinawa Community was called the world of god, and Villages were formed around woods named Utaki meaning the place of religious service, where people invite gods. It was a woman that invite god, the woman was so called Onari, in Okinawa women was named Onari and men-Ekeri, Onari was guardian god for Ekieri, with developing of the community. Onari became Noro, later, armed man begun to conquer the village, who was called Aji-a ruler there. It's greatest one was King. King ruled with Noro separating government from religious service. In 1609, when the Shimazu-feudal clan of Satuma invaded there, since the divine status of woman changed and became decline gradually. The next one, let us refer to Moasobi. Marriage of common people in Okinawa was usually through Moasobi. Moasobi means that people play in the field. The young ware playing and singing and dancing with the Samisen in hand in the field, then the yonng man and woman united naturally. As in Meiji era, government prohibited it, and Moasobi changed into illicit marriage. I firmly belive that marriage in moasobi in night of southern islands fulled with deep blue beauty is marriage of human life in itself.

    A matter of great importance to maintain democracy is establishment of equal justice. However, at present, the poor suspects who account for more than half of all, are dealed as the objects of criminal investigation without assist of counsel in Japan. Criminal investigation stage is the most critical one when the fundamental human rights are liable to be invaded.
