本論文は、刑法学者・

一郎の安楽死論の検討を通して、「安楽死の比較文化論」を構想するものである。小野は安楽死について詳しく研究した人ではないが、その安楽死論には、第一に重要な判例である山内事件名古屋高裁判決（1962年）に影響を与えたこと、第二に社会的合理性と個人の意思を根拠とする近代の安楽死論の批判として意味があること、そして最後に人道主義的慈悲殺論について再考する契機になること、という3つの意義がある。本論文では、これらの意義に関連する問題として、合理主義的議論も、人道主義的慈悲殺論も、どちらも「滑り坂」に拍車をかけるものにも、また逆にそれに歯止めをかけるものにもなりうる両義性をもつということが確認される。そして、各々がどちらの機能を果たすかは「文化」に依るのではないか、 従って「安楽死の比較文化論」が必要ではないかという問題が提起される。それから本論文では、 関係諸国（東西）の「安楽死・尊厳死」問題を比較する枠組として、「法治」と「徳治」という対抗図式を設定して、アメリ力・日本及びオランダの事例を批判的に検証する。

In this paper, the dependence of the distribution of rice yield in Aomori prefecture in 1971 on cool weather conditions in summer season was investigated, on the basis of both relationship between the rice yield and cool weather conditions and data on the occurrence of low air temperature in the season.
A presumptive standard to predict the extent of yield decrease caused by low temperature weather condition is proposed by the relative correlation among the extent of yield decrease and “ripening temperature” (which is an average temperature of mean maximum and minimum day temperature during 40 days after heading) and a spell of low temperature for 5 days in flowering and pregnant stages.
As a result, it was shown that the accuracy of the prediction of the rice yield is right within the scope of 5% average error.
