This article examines the implications of the U.S. Supreme Court’ s 2023 decision in Students for Fair Admissions v. Harvard, which ruled that affirmative action programs considering race in college admissions violate the Equal Protection Clause. Following the ruling, many DEI-based affirmative action initiatives in the U.S. are facing legal challenges and are being forced to change. Japanese universities have implemented women-only admissions quotas in STEM fields as part of DEI efforts, citing international trends among other justifications. However, given these developments, it is necessary to critically reconsider such policies in Japan. Focusing on Chief Justice Roberts’ s majority opinion and Justice Thomas’ s concurring opinion, the article explores theories and societal impacts to provide insights for re-evaluating affirmative action in Japan’ s STEM education.
