人権概念の拡張に係る立法過程

This paper analyzed a trend of legislation processes affecting the expansion of the human rights concept in late years. From a legislation trend in the Diet, I pointed out a sign of distinction fluidity, of a cabinet bill and a Diet member’s bill. As case studies, Domestic Violence Prevention Law, Gender Identity Disorder Special Law, Support for Persons with Developmental Disabilities Act, I took, and examined the legislative process. From these examples, I found the citizen is not so influential in a legislation process.

From a view point of a political process, to establish laws affecting the expansion of the human rights, depends on a change of political opportunity structures, ruling coalition established, and a change in the way of the bill proposed.

Furthermore from the contents, I found that human rights were secured by fundamental laws and principle laws, and policy making abilities of citizens’ contributed to make a low.
