    Until very recently, the Japan had no law in place requiring contaminated land to be clearly identified by a regulatory agency. Neither was there a law in place requiring an owner or a developer of contaminated land to: delineate the contamination present on that land; evaluate the significance of this contamination; assess the risks it poses to human health or the environment; or clean up the land to an acceptable state. This paper is discussed on the background and approch to the law system that operates in the Japan.

  • Three cases in the U. K. from the perspectives of care for the public

    Due to the economic restructuring, brownfields such as former industrial sites, landfill sites, and coalfields are in the time of changing the its uses of the land. These sites may suffer from land contamination due to the previous activities on the land, and if there are contamination, approaches to treat contaminated land is inevitable, in order to prevent land contamination problems. This study is to clarify the process of approaches of contaminated land and redevelopment by investigating three cases and to seek for better way forward in Japan. The research method used is the interviews.
    From the results, it became clear that English Partnerships (Present; Regional Development Agencies) and Scottish Enterprise have been providing the funding and linking the approaches of contaminated land and redevelopment, which also enables to reduce cost and time. Local authorities maintains information on land by the database and communicate with other departments and organisations from the stage of investigation. Lastly, job creation is also considered to be important when redeveloping the land, as well as to improve the environment by investigation and remediation.

    Although the demand of real estate appraisal concerned contaminated site is increasing, the real estate appraiser in our country is not getting used to that kind of evaluation. The possibility that we can adopt Cost Approach is relatively high, Market Approach is almost nonexistent and Income approach is middle degree.

  • Comparison Research of Cleanup Cost and Stigma between Japan and USA

    Recently, transaction of contaminated site is one of major issues of real estate and real estate appraisal industry in Japan.The people have come to demand the appraisal of contaminated site.Since the United States is an advanced country in the valuation of contaminated site, the idea of US becomes reference very much for development of appraisal technique in Japan.The purpose of paper is to introduce the present situation of appraisal for contaminated site in Japan with comparison study between US and Japan.There are three major factors, that is, uncontaminated value, cleanup cost and stigma, to estimate the value of contaminated site.Most difficult problem is how to estimate negative value adjustment caused by stigma.I discuss about these three factors from both theoretical and practical aspects.
