The Rental Housing Management Business Law enacted in 2020 regulates sublessors and provides the registration system for rental housing managers. In addition, it also defines a rental property manager as the business manager. It is expected that the law will establish the rental property management business and create new professionals. It is necessary to improve the existing rental management, which was strongly focused on building maintenance, to one that incorporates concepts such as asset management and property management.

In this paper, I critically discuss the Act on Appropriate Management of Rental Housing (Chintai Jutaku Kanrigyou Hou, in Japanese) and consider the measures that should be taken to solve the problems in master lease agreements. Then, I propose to revise Japanese Housing Tenancy Law and to change the jurisdiction of the tenancy law from the Ministry of Justice to the Ministry of Land, Infrastructure, Transport and Tourism.

The Rental Housing Management Business Law of 2021 mandates that security deposits be segregated. However, only a simple separate accounting is allowed for the segregated management method. I consider such a method to be inadequate. Therefore, I have considered a method of complete segregation of security deposits with reference to the German system of security deposits. I have considered how to fully protect the security deposit to be returned to the lessee in the event of bankruptcy of the lessor or property manager.

Emergency temporary housing is provided to those who have lost their homes due to the disaster. After the Great East Japan Earthquake in 2011, rental type emergency housing became the primary method of providing emergency temporary housing. This type of housing is rented by the prefecture from owners and subleased to disaster victims, with housing management companies acting as intermediaries. In the process of providing such housing, housing management companies play important roles as follows: ⑴ Early provision of vacant houses in move-in phase; ⑵ Monitoring victims in residence phase; ⑶ Support for housing reconstruction in move-out phase.

The following issues must be addressed in order to make more rental housing available for DIY to accommodate the diverse intentions of residents. First, educate landlords, residents, and management companies on the details of the contract and how the building works. Second, create housing that facilitates DIY. Third, clarify the contractual terms and conditions for DIY. Fourth, develop a social system that supports DIY-enabled rental housing.

That is, by fostering connections between residents and the townspeople in a vintage-nuanced “Retro Building”, the building becomes into “self-propelled”. There are two opportunity costs for vacant buildings:(i) value of the building depreciates without a usage of the building and (ii) in case service life of the building has already passed, demolition to utilize the land is delayed. A framework to estimate these costs is proposed, using a depreciation curve and data on household-owned vacant detached houses for entire Japan from Housing and Land Survey. The cost for a year is estimated as 86 billion JPY and the cumulative cost to date for current vacant houses is estimated as 651 billion JPY, mainly from the building depreciation channel at an early stage of a building life.
