This paper intended to make a clear grasp of a general picture and feature of rural planning system in China. For this purpose, the writer first examined the development of legislation on rural planning in China systematically from 1949 to present. Secondly, identified the characteristics of rural planning system in China and gave a clear picture of present legislative system and management system of rural planning, focusing on “Regulations on Control of Planning and Construction in Towns and Villages”. Finally, a detailed description about some basic structures of enforcement of rural planning and promotion of rural construction have been made to promote better understanding for rural planning system in China. The major points of the analyses are as follows.
1. The historical development of the legislation for rural planning went through three phases, namely, preconditioning period (1949-78), experimental period (78-93), and maturity phase (93-present) . It entered in the new era after promulgation of “Regulation on control of planning and construction in towns and villages” in 1993.
2. The legistaion was developed step by step, based on the actual conditions of rural areas, and by solving problems that surfaced in course of applying planning systems. For example, in addition to the conventional economic effect, social and environmental effects were emphasized for more comprehensive development.
3. For the implementation of the law, preparation of administrative organization were nearly completed from national, prefectural, district, to local levels, but there is a shortage of staff in those offices.
4. As a characteristics of legal system, the central government set forth only principles and allow local offices to prepare operational regulations and implementation detailes. Inter-regional support or voluntary self-support by fund in agricultural villages and inducement by planning are emphasized rather than public support by central government. The planning system consists of comprehensive planning and construction planning.
